Article 1 (Purpose)
These Terms of Use (hereinafter referred to as “these Terms”) set forth the terms and conditions for using the service (hereinafter referred to as “the Service”) provided by the operator of the Service (hereinafter referred to as “the Operator”). All users of the Service (hereinafter referred to as “Users”) shall be deemed to have agreed to these Terms and shall use the Service in accordance with the provisions herein.
Article 2 (Scope of Service)
The Service is a platform designed for recording, organizing, and sharing information related to coffee, as well as for communication among Users. Details regarding the specific features and services provided shall be posted on the website or within the application as separately designated by the Operator.
Article 3 (Membership Registration)
- To use certain features of the Service, Users must agree to these Terms and register an account (hereinafter “Membership Registration”) by following the procedures specified by the Operator.
- When entering registration information, Users shall provide information that is true, accurate, and up-to-date. If any changes occur to the registration information, Users shall promptly update their information.
- Registration using false information, impersonation, or registration for the purpose of fraudulent use is strictly prohibited.
- Users shall strictly manage their accounts and passwords at their own risk and shall not allow third parties to use them, nor shall they transfer, lend, or otherwise disclose them to third parties.
Article 4 (Paid Membership)
- This Service includes “MEMBERSHIP” (hereinafter referred to as the “Paid Plan”), which provides paid premium features.
- Paid members may use limited services, such as specific posting and bookmarking features, by paying the monthly usage fee set by the Operator via the designated payment method.
- “Stripe,” a third-party payment service, is used for the payment and management of Paid Plans. Upon making a payment, the User agrees to and shall comply with the Terms of Service established by Stripe.
- Unless otherwise provided by law, no refunds of paid usage fees, nor prorated refunds, shall be issued for any reason whatsoever.
Article 5 (Prohibited Acts)
Users shall not engage in the following acts when using this Service.
- Acts that violate laws and regulations, court judgments, decisions, or orders, or legally binding administrative measures
- Acts that violate public order and morals, or acts that may do so
- Acts that infringe upon the copyrights, trademark rights, privacy rights, portrait rights, or other rights of the Operator, other users, or third parties
- Entering false information during member registration or while using the Service
- Impersonating other users or third parties
- Reproducing or using another person’s images, text, or other copyrighted works without proper authorization
- Posting fake images created by generative AI or content that is likely to cause misunderstanding
- Acts that place an excessive load on the Service’s servers or network systems, or acts that interfere with the operation of the Service
- Unauthorized access, reverse engineering, or other attempts to analyze or attack the Service
- Posting spam, making repeated posts, or soliciting an unspecified number of users
- Registering or transmitting data clearly unrelated to the purpose of the Service, or harmful programs, etc.
- Any other acts deemed inappropriate by the Operator
Article 6 (Posted Content)
- Users may only post images and information to this Service for which they hold legitimate rights or have obtained the necessary permissions.
- Users shall bear full responsibility for any text, images, or other content (hereinafter “Posted Content”) they post to this Service.
- Users grant the Operator the right to use (including reproduction, adaptation, and public transmission) Posted Content, free of charge and on a non-exclusive basis, to the extent necessary for the provision, maintenance, improvement, or promotion of this Service.
- The Operator may delete, move, or hide all or part of the Posted Content without prior notice to the user if the Operator deems it necessary for the sound operation and maintenance of this Service.
Article 7 (Intellectual Property Rights)
Copyrights, trademark rights, and all other intellectual property rights pertaining to the text, designs, graphics, programs, systems, logos, and all other content comprising this Service belong to the Operator or third parties holding legitimate rights thereto. Users may not reproduce, reprint, modify, or otherwise reuse such content without the Operator’s prior written consent.
Article 8 (Withdrawal and Restrictions on Use)
- Users may withdraw from this Service and delete their membership registration at any time by following the procedures specified by the Operator. If there are any outstanding debts at the time of withdrawal, the User shall settle them immediately.
- If a user violates any provision of these Terms of Service, or if the Operator determines that there is a risk of such a violation, the Operator may take measures such as suspending the account, deleting posted content, or enforcing withdrawal from the Service without prior notice or demand.
Article 9 (Disclaimer)
- The Operator makes no warranty, either express or implied, that the Service is free from factual or legal defects (including defects in safety, reliability, accuracy, completeness, validity, fitness for a particular purpose, security, etc., as well as errors, bugs, and infringements of rights).
- The Operator shall not be liable for any damages incurred by Users as a result of using this Service, except in cases where the Operator has acted with intent or gross negligence.
- Even if the Operator is held liable for any reason, the Operator’s liability shall be limited to direct and actual ordinary damages incurred by the User, and the Operator shall not be liable for incidental, indirect, special, or future damages, regardless of whether such damages were foreseeable.
Article 10 (Modification, Suspension, and Termination of the Service)
- The Operator may modify, add to, or temporarily suspend all or part of the content of the Service without prior notice to Users.
- The Operator may terminate the provision of the Service by giving reasonable notice, such as through an announcement on the website, provided there are reasonable grounds for doing so.
Article 11 (Amendments to the Terms of Use)
- The Operator may amend these Terms at any time if it deems it necessary.
- When amending these Terms, the Operator shall specify the effective date of the amended Terms and, prior to such effective date, notify Users of the amendment and the content of the amended Terms by posting them on the website or by other appropriate means.
- If a User uses the Service after the amended Terms take effect, the User shall be deemed to have agreed to the amended Terms of Use.
Article 12 (Governing Law and Jurisdiction)
- These Terms of Service shall be governed by and construed in accordance with the laws of Japan.
- Any and all disputes arising between the User and the Operator regarding the Service or these Terms of Service shall be subject to the exclusive agreed jurisdiction of the District Court or Summary Court having jurisdiction over the Operator’s place of business as the court of first instance.
